Trees in the Verge

This page explains who is responsible for the area, known as the verge (or road yard), between sidewalks and streets in the City of Elkins.

What Is the "Verge" or "Road Yard"?

Verge in Elkins, WV.The verge—sometimes called the road yard or strip—is the area of land between the sidewalk and the roadway. It’s part of the public right-of-way, but under Elkins City Code, the day-to-day care of this space falls to the owner or occupant of the property adjacent to it.

Who Is Responsible for Trees and Plants in the Verge?

If you own or occupy property next to a street in Elkins, you’re responsible for maintaining the verge area adjacent to your property (just as you are responsible for maintaining the sidewalk in front of your property). This includes:

  • Trees, no matter when they were planted
  • Brush
  • Grass and weeds
  • Any other plant growth

No matter who planted the tree or how it got there , keeping this area safe and well-maintained is the property owner’s responsibility. In particular, this means property owners must address trees that are:

  • Dead or dying
  • Damaged or leaning in any way that could be hazardous
  • Blocking visibility for drivers or pedestrians
  • Interfering with water drainage

By taking care of the verge, you will help keep Elkins’ neighborhoods safe, clean, and accessible for everyone.

What Happens If a Tree in the Verge Becomes a Problem?

If a tree or other vegetation within the verge poses a safety risk or violates city code, the property owner is expected to arrange for its removal or trimming. If the property owner doesn’t address the problem, the City may step in to ensure the work is done for the safety of the community.

If your property borders a sidewalk and street:

  • You’re responsible for maintaining the verge, including any trees in it.
  • Please proactively manage trees or plants that could become safety or drainage issues.
  • Addressing trees and brush that pose safety or property damage risks helps avoid the need for City intervention and keeps our shared spaces in good shape.
